1. Overview

These Terms of Service (the “Terms”) govern your use of almavenn.com and purchases from ALMA VENN (“ALMA VENN,” “we,” “us,” or “our”). Shopify provides the ecommerce platform, but your purchase contract is directly with ALMA VENN. ALMA VENN is based in British Columbia, Canada. By using the site or placing an order, you agree to these Terms and the policies linked from them. Nothing in these Terms limits any right or remedy that cannot lawfully be excluded under applicable consumer protection law.

2. Eligibility and accounts

You must be the age of majority in your province, state, or territory, or use the Services with the permission and supervision of a parent or legal guardian. You must provide accurate, current information and keep account credentials secure. You are responsible for activity carried out through your account.

3. Products and availability

We aim to describe products, materials, sizing, colours, and availability accurately. Screen settings and manufacturing variations can affect how colours and details appear. Product descriptions and images do not remove or replace any warranty, condition, or consumer right imposed by law.

Products may be fulfilled from different locations and may arrive in separate packages. We may limit quantities, correct genuine errors, or discontinue products. If an ordered item becomes unavailable, we will cancel the affected item and issue a full refund for it.

4. Orders and contract formation

Submitting an order is an offer to purchase. Before payment, checkout gives you an opportunity to review and correct your order, delivery information, and total. A contract is formed when we send an order confirmation accepting the order to the email address supplied at checkout. That confirmation, together with the policies linked in it, is your copy of the contract and should be saved for your records.

If we cannot accept an order, we will notify you and refund any amount charged. We may refuse or cancel an order where reasonably necessary, including for suspected fraud, unlawful activity, obvious pricing or inventory errors, or delivery restrictions. We will not cancel an accepted order merely to charge a higher price.

5. Prices, currency, taxes, and import charges

Prices are shown in the currency selected for your market. The itemized subtotal, discounts, shipping charges, applicable taxes, and order total are displayed at checkout before payment. Government imposed taxes are charged when required by law.

For cross border orders, customs duties, import taxes, brokerage fees, and similar government or carrier charges may apply unless checkout expressly states that they are included. These charges are described further in our Shipping Policy.

6. Shipping, delivery, delays, and risk of loss

Processing and transit estimates, including the supply date for your order, are shown in our Shipping Policy and, where available, at checkout or in the order confirmation. The delivery location is the address you provide at checkout. Orders are shipped as parcels by Canada Post, USPS, UPS, FedEx, DHL, or another carrier selected for the fulfillment origin and destination. Tracking will identify the carrier when available.

Delivery dates are estimates unless we expressly promise a guaranteed date. If we learn that we cannot ship within the promised or advertised time, or within the period required by law, we will provide a delay notice and a revised estimate when available. Where required, we will ask whether you agree to wait or prefer to cancel for a full refund. If we cannot fulfill the order, we will cancel it and issue a prompt refund.

Except where applicable law provides otherwise, risk of loss remains with ALMA VENN until the order is delivered to the address provided at checkout. Please review our Shipping Policy for delivery arrangements and reporting a missing or damaged package.

7. Returns, refunds, and cancellation rights

Our voluntary return conditions are described in our Refund Policy. Those conditions do not override statutory cancellation, refund, warranty, or other consumer rights. Where a customer validly cancels under applicable distance sales law, we will provide the refund required by that law within the required time.

8. Acceptable use

You may use the Services only for lawful personal or household purposes. You must not misuse the site, interfere with its security or operation, introduce malicious code, scrape or access it by unauthorized automated means, impersonate another person, violate another person’s rights, or use the Services for unlawful, fraudulent, abusive, or resale activity.

9. Intellectual property

The ALMA VENN name, site design, original text, graphics, and other original content are owned by or licensed to ALMA VENN. Product images, brand names, and other third party materials may belong to their respective owners and are used under licence or other lawful authority. You may use site content only for personal, non commercial shopping purposes. No other licence is granted.

10. Third party services and Shopify

The Services may use Shopify and other providers for hosting, payments, fraud prevention, fulfillment, shipping, analytics, and related functions. Third party services may have their own terms and privacy notices. Shopify provides the ecommerce platform but is not the seller of products purchased from ALMA VENN.

11. Privacy and marketing

Our collection, use, disclosure, retention, and international processing of personal information is described in our Privacy Policy. Promotional email is sent only where we have a lawful basis or consent. You may unsubscribe using the link in a marketing email; transactional messages about orders and accounts may still be sent.

12. Service availability and liability

We work to keep the site accurate, secure, and available but cannot promise uninterrupted or error free access. To the maximum extent permitted by law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or breach of mandatory consumer rights.

13. Governing law and disputes

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, without limiting any mandatory protection available to you under the law of your place of residence. Before starting formal proceedings, please contact support@almavenn.com so we can try to resolve the issue promptly. You retain the right to use any court, regulator, consumer protection process, or other remedy available under applicable law.

14. Changes, severability, and no waiver

We may update these Terms for legal, security, or operational reasons. The version posted when an order is accepted governs that purchase unless the law requires otherwise. If a provision is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.
